1. GENERAL INFORMATIONS
1.1. ASSOCIATION IDENTITY
The website https://acmo.ro, as well as all services, projects, activities, programs, campaigns, events and resources made available through it, are managed by the ASSOCIATION OF ONLINE CONTENT AND MODELS CREATORS (ACCMO), a non-governmental organization with its registered office in Bucharest, Sector 3, Nerva Traian Street No. 27-33, Building A, Floor 4, Apartment 38, VAT ID 54674516, legally represented by the Chairman, Mr. Adrian IONESCU, referred to as
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) is a non-governmental, independent and apolitical organization, founded with the purpose of representing, supporting and promoting, at professional, social and institutional level, the interests of individuals who work in the field of digital content creation for adults and online modeling activities in Romania.
ACCMO aims to provide an organized, transparent, and accountable framework for the development of a professional community united by collaboration, mutual respect, and best practices. The association seeks to strengthen the identity of this industry, facilitate dialogue between members of the community and public institutions, and promote professional and ethical standards that contribute to the sustainable development of the field.
ACCMO not only follows the reunification of content creators and online models under a common identity, but also the development of a functional and credible structure capable of responsibly representing the interests of the community, facilitating the exchange of information and experience, organizing projects, programs and events of mutual interest, and promoting initiatives that contribute to the recognition and professionalization of this sector of activity.
The association addresses all individuals who are active or intend to be active in the digital content creation industry for adults and who wish to become part of an organized community, benefit from professional development opportunities, networking, information and institutional representation, in an environment based on integrity, responsibility and mutual respect.
In carrying out its objectives, ACCMO undertakes professional, social and institutional representation activities without undertaking legal, legal assistance or legal consulting activities in the sense of Law No. 51/1995 on the organization and exercise of the profession of lawyer.
The Terms and Conditions regulate the legal relationship between ACCMO and any natural or legal person who accesses the website, requests information, purchases services, makes donations, applies to become a member or supporter, or benefits from the Association's services, programs, projects, events, or resources, referred to as
1.2. LEGAL AND CHARACTER OF SERVICES PROVIDED
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) is a non-governmental, independent, apolitical and non-profit organization, established in accordance with Romanian legislation applicable to associations and foundations, with the objective of developing, supporting and representing the community of digital content creators and online models from Romania.
In carrying out its statutory purpose, ACCMO undertakes activities aimed at the professional and community development of its members and supporters, promoting best practices in the industry and consolidating a collaborative environment based on professionalism, responsibility and mutual respect.
The activities of the Association may include, among others:
* representation of professional and institutional interests of members and supporters;
* organization of conferences, seminars, workshops, courses, professional meetings and other events dedicated to the community
* the development and implementation of projects, programs and campaigns for information, education and awareness;
* facilitating collaboration and knowledge sharing between content creators, online models, partners, and other organizations;
* promoting professional standards, ethics and best practices in the field of digital content creation;
* the development and administration of the ACCMO community and digital platforms operated by the Association;
* providing information, administrative and professional support to members and supporters
* identifying and promoting opportunities for collaboration, professional development, and networking
* concluding partnerships and collaborations with individuals, legal entities, organizations and institutions in the country and abroad;
* carrying out any other activities permitted by law and provided for in the Association's Statute
Through all its activities, ACCMO aims to consolidate a professional community that is united and well represented, promoting transparency, continuous development, collaboration, and the respect of the legitimate rights and interests of digital content creators and online models.
1.3. ACCEPTANCE OF TERMS AND CONDITIONS
By accessing and using the website [www.acmo.ro](http://www.acmo.ro), creating a user account, completing the available forms on the site, requesting membership or support, making a donation, participating in activities, projects, programs or events organized by the Association, submitting a request to the Association or using, in any way, the services and facilities provided by the ASSOCIATION OF ONLINE CONTENT AND MODELS CREATORS (ACCMO), any member, supporter, collaborator, partner, user or visitor expressly declares that:
* I have read and understood the entire present Terms and Conditions document.
* I have understood the content and legal effects of this;
* freely accepts, expressly, unequivocally and fully all provisions contained in this document;
* understand the nature and purpose of the activities carried out by the Association, as well as the conditions under which they are organized;
* declares that the information provided to the Association is real, complete and up-to-date and undertakes to communicate any changes thereof;
* The user must use the website, digital platforms, community and services offered by the Association in good faith, in compliance with applicable laws, the Association's Statute, internal regulations and these Terms and Conditions.
Accepting these Terms and Conditions creates legally binding obligations between the user and the Association, representing the agreement of intent of the parties regarding the use of the website, participation in the activities of the Association, and the exercise of rights and obligations arising from the legal relationship established between them, to the extent permitted by law.
1.4. THE INFORMATIONAL CHARACTER OF PUBLISHED CONTENT
All information published on the [www.acmo.ro](http://www.acmo.ro) website, on official social media pages, in informative materials, presentations, brochures, newsletters, communication campaigns, promotional materials or in any other publications belonging to the ONLINE CONTENT AND MODELS CREATORS ASSOCIATION (ACCMO), has an exclusive informative, educational and orientative character and is intended to support the professional and personal development of members, supporters, collaborators, partners and users.
The materials published by the Association, including guides, recommendations, presentations, studies, articles, document templates, practical examples, interviews, video materials, photographs, statistics, case studies or any other resources made available have an exclusive informative role and do not constitute guarantees regarding obtaining professional, economic, financial, commercial or any other results.
The examples of best practices, the experiences presented by members or collaborators, case studies, results obtained by certain individuals, visual materials or any other examples published by the Association have an illustrative character and cannot be interpreted as representing promises, guarantees or commitments regarding the achievement of similar results by anyone.
The results obtained by each content creator, model, member, supporter or collaborator depend on numerous individual factors, including, but not limited to:
* professional experience and level of training
* the quality and originality of the content created;
* the time and resources invested in developing the activity
* guidance and recommendations provided by the Association;
* respecting applicable laws and policies of the platforms used;
* market conditions and evolution
* collaborations and existing professional opportunities
* independent economic, technical and commercial entities
* any other circumstances that may influence the development of the person's activity
The ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) does not guarantee the achievement of professional, financial, commercial or other results and is not liable for decisions made by members, supporters, collaborators, partners or users based solely on information published or communicated by the Association.
The use of information, materials and resources provided by the Association is carried out at the sole responsibility of the user, who has the obligation to independently analyze the suitability of their application in accordance with his specific situation.
1.5. RIGHT TO MODIFY SERVICES AND CONTRACTUAL DOCUMENTATION
The association reserves the right to modify, complete, suspend, or delete at any time:
* the services offered
* activities, projects, programs and events organized
* the fees, contributions, taxes or other applicable amounts;
* participation conditions
* the benefits, facilities or resources made available to members and supporters;
* internal policies
* this document
* contractual documentation, forms and procedures used in relation with members, supporters, collaborators, partners and users
The changes become opposable from the time they are published on the official website of the Association or communicated through the official means used by ACCMO.
Continued use of the website, services, or digital platforms or participation in association activities after updating documents constitutes acceptance of the new provisions to the extent permitted by law.
2. OBJECT OF THE SERVICES
2.1. ACTIVITIES AND SERVICES
The association carries out activities in the interest of its members and the community of digital content creators for adults, including, but not limited to: professional, social and institutional non-legal representation; organization of conferences, courses, workshops and events; information and education campaigns; networking; professional development programs; dialogue with authorities and institutions; promotion of best practices; national and international projects; administrative and informational support; facilitation of access to partners and benefits for members and supporters.
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) actively provides its activities, projects, programs, events and resources through its website [www.acmo.ro](http://www.acmo.ro), official communication channels, digital platforms managed by the Association, as well as, where appropriate, through physical meetings, events, conferences, workshops or other direct forms of interaction with its members, supporters, collaborators and partners.
The activities, projects, programs, events, courses, workshops, conferences, working groups, digital platforms and any other services or facilities provided by the ASSOCIATION OF CONTENT AND ONLINE MODELS (ACCMO) are organized in accordance with the purpose and objectives of the Association, in compliance with applicable legislation and internal regulations.
Participation in activities organized by the Association may be conditional, depending on the case, on meeting the eligibility criteria established by the Association, obtaining membership or supporter status, paying dues or contributions due, prior registration, confirming participation, as well as completing the required documents and forms, including declarations, agreements and documentation related to personal data protection.
The association reserves the right to refuse, suspend, limit, postpone or terminate a person's participation in activities, projects, events, platforms or services made available if they do not meet the requirements, provide false or incomplete information, violate the provisions of the Statute, internal regulations, present Terms and Conditions or engage in activities that may damage the image, legitimate interests, heritage, members or proper functioning of the association.
The activities and services offered by the Association are adapted according to the specific requirements of each project, program or event and may be modified, supplemented, suspended or discontinued depending on available resources, the number of participants, existing partnerships, legislative changes or any other objective circumstances. The Association does not guarantee permanent access to all activities or obtaining of professional, economic or commercial benefits as a result of participation in them.
3. PRICES AND PAYMENT METHODS
3.1. PUBLIC AREA PRICES
The fees for the services provided by ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) are displayed on the official website [www.acmo.ro](http://www.acmo.ro), on the communication platforms used by the Association, or can be communicated directly to members, supporters, collaborators, users or visitors by authorized representatives of the Association.
The association reserves the right to determine, modify, update or delete, at any time, the amount of fees, contributions, registration fees, event participation fees, course fees, workshops, conferences, programs or other activities organized, as well as any other financial costs or benefits related to its activity, in accordance with the Statute, the decisions of the governing bodies and internal regulations, without the obligation of prior individual notification. The changes will take effect from the date they are published on the association's official website, communicated electronically or through any other means used by the association.
The amount of fees, contributions, or taxes applicable is that communicated by the Association at the time of submitting the registration request, confirming participation in an event, project, or program, or at the date of termination of the legal relationship between the parties, unless caused by obvious material errors, display errors, technical or computer malfunctions, or other circumstances that significantly affect the accuracy of published information.
In the event of detecting obvious errors regarding the amount of fees, contributions, taxes or other sums published or communicated, the Association reserves the right to correct these errors, to request express confirmation from the interested party regarding the actual applicable value, or, in any case, to refuse or cancel registration, participation or the conclusion of a legal relationship until the situation is clarified, without this incurring liability for the Association.
3.2. PAYMENT METHODS
The fees, contributions, registration fees, event participation fees, courses, workshops, conferences, programs or other activities organized by the ASSOCIATION OF ONLINE CONTENT AND MODELS CREATORS (ACCMO), as well as donations or other amounts due to the Association, can be paid in cash, by credit card, by bank transfer, through online payment processors, via a payment link or by any other method of payment made available by the Association at the time of payment.
The association reserves the right to request advance payment, in full or partial, of membership fees, contributions, participation fees, or other amounts due for registration or participation in certain projects, programs, events, courses, conferences, workshops, or other activities organized, as well as for granting certain benefits intended for members or supporters.
In the event of non-payment of amounts due within the term and under the conditions communicated by the Association, it reserves the right to suspend or refuse registration or participation in activities organized, to suspend access to certain benefits, facilities, platforms or resources intended for members and supporters, as well as to suspend or terminate membership relations, in accordance with the Statute, internal regulations and this document.
Payments made to the Association will be highlighted and justified in accordance with applicable financial accounting legislation, and tax or invoicing documents will be issued in compliance with current legal requirements.
Payments made to the ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO), regardless of the payment method used, including but not limited to fees, contributions, registration fees, participation fees, donations, sponsorships, payments made by credit card, bank transfer, payment link, online payment processors or any other means provided by the Association, are considered firm, voluntary and final payments made in support of the statutory purpose, activities, projects, programs, events and services carried out by the Association.
Unless expressly provided for by law or in cases where the Association decides explicitly and in writing to grant a refund, amounts paid to ACCMO are not refundable. The Association does not offer refunds, reimbursements, cancellations of payments, returns of donations, refunds of membership fees, contributions, registration fees, participation fees, sponsorships or other amounts paid, including in the event that the person who made the payment subsequently renounces their membership or affiliation, no longer participates in the Association's activities, does not use available benefits, does not complete the registration procedure or decides not to collaborate with the Association.
The person making a payment declares that they have been informed about the destination of the paid amount, that they have carefully checked the payment details, the amount, the purpose of the payment and the applicable terms before completing the transaction, and that they understand the final and non-refundable nature of the payment, within the limits allowed by applicable law.
Any requests regarding the correction of obvious material errors, duplicate payments, unauthorized transactions or other exceptional situations will be analyzed individually by the Association, based on the documentation provided by the applicant, without this analysis constituting an automatic obligation to reimburse.
PROMOTIONS, DISCOUNTS AND COMMERCIAL OFFERS
The promotional campaigns, discounts, benefits, and other advantages offered to members or supporters, preferential participation fees, and any other benefits provided by the ASSOCIATION OF ONLINE CONTENT CREATORS AND MODELS (ACCMO) are temporary, limited, and optional in nature, and are applicable exclusively under the conditions, periods, and limits communicated officially by the Association.
The discounts, benefits and facilities granted by the Association cannot be combined with each other, unless the Association expressly provides otherwise. They do not apply retroactively to membership fees, contributions, taxes or other amounts already paid and do not grant members, supporters, collaborators, partners or users the right to request refunds or compensation for previous periods.
The association reserves the right to initiate, modify, suspend, extend, limit or terminate any promotional campaign, facility or benefit granted at any time, without prior notice, depending on available resources, existing partnerships, management decisions, organizational capacity or any other objective reasons that justify this measure.
Participation in promotional campaigns and the granting of benefits are carried out exclusively in accordance with the regulations or specific conditions communicated by the Association for each campaign, these supplementing, where applicable, the provisions of these Terms and Conditions.
4. OBLIGATIONS, RESPONSIBILITIES AND LIMITATION OF LIABILITY
4.1. OBLIGATIONS
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) undertakes to use all reasonable diligence, in good faith and in accordance with applicable legal provisions, to achieve its statutory purposes and objectives, as well as to organize and carry out activities, projects, programs, events and services intended for its members, supporters, collaborators and partners.
The association aims to develop a professional, transparent and responsible community, promoting collaboration, knowledge sharing, professional development, best practices and consolidating an organized framework for digital content creators and online influencers.
In carrying out its activities, the Association will make all reasonable efforts to:
* organizing activities and events under appropriate professional and transparent conditions
* providing accurate, up-to-date and relevant information to members, supporters and users;
* the responsible management of the Association's resources, assets and funds
* developing projects and partnerships that contribute to the achievement of the association's statutory purpose;
* protect the legitimate interests of members and supporters, within the limits of their statutory powers and functions;
* respecting legal obligations regarding the protection of personal data, transparency and good administration
The association makes reasonable efforts to ensure the accuracy, completeness and updating of information published on its official website [www.acmo.ro], on social media platforms and in any other informative or communication materials. However, certain information may contain material errors, omissions, technical inaccuracies or become outdated between the time of publication and the time of consultation.
The association reserves the right to modify, complete, suspend or temporarily or permanently terminate any activity, project, program, event, service, facility, digital platform, benefit provided to members, or any content published without prior individual notice when this measure is justified by legislative changes, decisions of governing bodies, lack of necessary resources, technical, organizational, financial, security reasons, or other objective circumstances.
The association does not guarantee the permanent availability of all activities, projects, events, facilities or benefits presented and cannot be held liable for the temporary or permanent inability to organize or carry out these, when this is determined by causes independent of its will or objective reasons that justify their modification or cessation.
4.2. Obligations of members, sympathizers, employees and users
The members, supporters, collaborators, partners, users and visitors of the ASSOCIATION OF CONTENT AND ONLINE MODELS (ACCMO) have a duty to provide the Association with real, complete, accurate and up-to-date information regarding their identity, contact details and any other information required for registration, participation in the Association's activities, exercising the rights conferred by membership or support, or conducting legal relations between the parties.
The persons referred to in the preceding paragraph declare that the information provided to the Association is accurate and that they understand that providing false, incomplete, inaccurate or outdated information may lead to the impossibility of granting certain benefits, suspension or termination of the relationship between the parties or the application of measures provided for in the Association's Statute, internal regulations and these Terms and Conditions.
The association cannot be held liable for damages, losses, or any other consequences resulting directly or indirectly from:
* providing false, incomplete, inaccurate or outdated information by a member, sympathizer, collaborator, partner or user;
* inappropriate use of information, documents, recommendations or resources made available by the Association
* failure to comply with the status of the Association, internal regulations, these Terms and Conditions or instructions provided by representatives of the Association
* abusive use of digital platforms, communication groups or resources managed by the Association
* violation of the legitimate rights and interests of other members, sympathizers, collaborators, partners or the Association
* any actions or omissions attributable solely to the person in question
Members, supporters, collaborators, partners and users are required to comply with applicable laws, the Association's statutes, internal regulations, decisions of governing bodies and these Terms and Conditions, as well as to behave in good faith, with mutual respect, professionalism and integrity in all relationships undertaken within or related to the Association's activities.
They are obligated not to engage in activities that could damage the image, reputation, heritage, legitimate interests or proper functioning of the Association and not to use the name, logo, visual identity or membership or supporter status for illegal purposes, contrary to the Statute or ACCMO's interests.
5. PROTECTION OF PERSONAL AND CONFIDENTIAL DATA
5.1. DATA PROCESSING WITH PERSONAL INFORMATION
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) processes the personal data of members, supporters, collaborators, partners, users and website visitors at [www.acmo.ro](http://www.acmo.ro) in accordance with the provisions of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data ("GDPR"), as well as all applicable legal provisions relating to the protection of data, confidentiality and information security.
The association declares that it has implemented the organizational and technical measures necessary to ensure compliance with Regulation (EU) 2016/679 (GDPR) and national legislation in matters of protection of personal data, and that it benefits from the services of a Data Protection Officer (DPO), appointed and registered in the General Register of Data Protection Officers maintained by the National Authority for Supervision of Personal Data Processing, under No. 17032 as of May 25, 2026, who ensures monitoring of compliance with legal obligations regarding the processing of personal data.
Within the scope of its activities, ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) may collect, record, store, organize, structure, consult, use, adapt, modify, transmit, archive, restrict or delete personal data provided directly by members, supporters, collaborators, partners, users or visitors, or collected in the context of legal, associative, contractual or website and platforms managed by the Association relationships, in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation.
The personal data processed by the Association may include, among others:
* name and surname
* personal identification number, series and number of the identity card, when required by law or for the purpose of entering into legal relations
* data and place of birth, citizenship and residence or address;
* email address and phone number
* date regarding user accounts created on the Association's platforms;
* member status, supporter, collaborator or partner;
* information on fees, contributions, donations, sponsorships and other financial accounting operations carried out in relation to the Association;
* date required for issuing fiscal, contractual or administrative documents;
* correspondence with the association;
* photos or videos taken during events organized by the Association, in accordance with the law;
* technical information regarding the use of the website [www.acmo.ro](http://www.acmo.ro), including IP address, online identifiers, device data, cookies and other information collected in accordance with the consent mechanism for cookies available on the website;
* any other personal data necessary for the legal conduct of the Association's activities and the fulfillment of its statutory purpose
The individuals concerned declare that they understand and accept that certain categories of personal data are necessary for managing their relationship with the Association, for maintaining membership records, organizing activities, communicating with interested parties, fulfilling legal, accounting, and tax obligations, as well as for exercising the rights and obligations arising from the Association's statutes, internal regulations, and these Terms and Conditions.
In the event that, for certain projects, programs or activities, the Association processes special categories of personal data, this processing will be carried out exclusively in accordance with and under the terms of Regulation (EU) 2016/679 and applicable law, in compliance with the principles of legality, necessity and proportionality.
5.2. SCOPE AND LEGAL BASIS OF PROCESSING
The personal data is processed by ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) exclusively for specific, explicit, legitimate and compatible purposes with the activity carried out by the Association, including, without limitation:
* managing relationships with members, supporters, collaborators, partners and users
* analyzing and resolving registration, membership, participation or collaboration requests
* managing the records of members, supporters and collaborators of the Association;
* organizing and carrying out projects, programs, events, conferences, workshops, courses, and other regular activities;
* communication with members, supporters, collaborators, partners and users through electronic or traditional means
* issuing contractual, administrative, financial and tax documents
* collecting membership fees, contributions, donations, sponsorships and other amounts due to the Association;
* handling requests, complaints, petitions, and potential disputes;
* administration and security of the website [www.acmo.ro](http://www.acmo.ro), digital platforms and IT systems used by the Association;
* promoting the activities and projects of the Association, in accordance with the law;
* fulfilling legal, statutory and tax obligations that apply to the Association
* protecting the rights, property, image and legitimate interests of the Association and its members
Processing of personal data is carried out on the basis of one or more legal grounds provided for in Regulation (EU) 2016/679 and applicable national legislation, respectively:
* carrying out a contract or taking the necessary steps before its conclusion, at the request of the party involved;
* fulfilling legal obligations that apply to the Association;
* achieving the legitimate interests pursued by the Association, to the extent that they do not prevail over the fundamental rights and freedoms of the person concerned
* express consent of the person concerned, when required by law;
* Fulfilling obligations and exercising specific rights in the field of association law, tax, accounting or other areas provided for by law.
In the event that, within projects, programs or activities organized by the Association, it is necessary to process certain categories of personal data, this will be carried out exclusively in accordance with and under the terms of Regulation (EU) 2016/679 and applicable law, while respecting the principles of legality, proportionality, necessity and confidentiality.
5.3. ELECTRONIC COMMUNICATION AND ONLINE CORRESPONDENCE
The member, sympathizer, collaborator, partner, user or visitor understands and accepts that the relationship with ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) may involve the use of electronic communication means, including telephone calls, email, SMS, WhatsApp, Telegram, social media platforms, messaging applications, community platforms or any other means of communication used by the Association to transmit information, confirm registrations, communicate about projects, events, activities, benefits, contractual or administrative documentation, as well as for any other communications necessary for the conduct of the relationship between the parties.
The member, sympathizer, collaborator, partner, user or visitor declares that they agree to receive communications electronically and recognizes that messages sent to the contact details provided to the Association may have legal effects in accordance with the law and these Terms and Conditions.
Although the Association makes every reasonable effort to ensure the security of computer systems and electronic communications, the persons referred to in the preceding paragraph understand and accept that transmitting information through the internet and electronic platforms may involve technical risks independent of the Association's will and control, such as service interruptions, delays in message transmission, unauthorized access, cyberattacks, technical malfunctions or other incidents specific to electronic communication.
The association cannot be held liable for delays, errors, or the inability to transmit or receive electronic communications caused by telecommunications service providers, the operation of computer networks, or other circumstances beyond its control, provided that it has taken all reasonable measures to ensure the proper functioning of communications.
5.4. DATA STORAGE DURATION
The personal data and documents provided or generated in the context of the relationship between the subject and ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) will be processed and stored only for the period necessary to achieve the purposes for which they were collected, as well as subsequently, for the duration provided by applicable law or necessary for exercising, establishing, or defending a right in court or for protecting the legitimate interests of the Association.
Personal data may be stored for the duration of the association, contractual or collaborative relationships between the individual and the Association, as well as subsequently, for the period imposed by legal provisions regarding member records, financial and tax obligations, document archiving, fraud prevention, complaint resolution or litigation, and the performance of any other legal obligations incumbent on the Association.
Upon expiration of the periods of storage provided for by law or those established in accordance with the purposes of processing, personal data will be deleted, anonymized or destroyed in a secure manner, in accordance with the internal procedures of the Association and in compliance with the principles set out in Regulation (EU) 2016/679 and applicable national legislation.
In the event that the data subject requests the deletion of their personal data before the end of the retention periods, the Association will review the request and proceed to delete them if there is no legal, contractual or legitimate interest obligation to continue processing or storing the data.
Personal rights of the persons involved
Members, supporters, collaborators, partners, users and visitors whose personal data is processed by ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) have all the rights recognized by Regulation (EU) 2016/679 (GDPR) and applicable national legislation, including, without limitation, the right to access personal data, the right to rectify inaccurate or incomplete data, the right to erasure (

In order to protect the confidentiality and security of personal data, the Association reserves the right to request additional information or documents necessary for verifying the identity of the person making the request when there are reasonable doubts about their identity or when such verification is necessary to prevent unauthorized access to personal data.
If the data subject believes that the processing of their personal data violates applicable legal provisions, they have the right to file a complaint with the National Data Protection Authority without prejudice to their right to address competent courts to defend their legitimate rights and interests.
Intellectual property rights
The entire content available on the official website [www.acmo.ro](http://www.acmo.ro), as well as within digital platforms, applications, communication groups, informational and promotional materials, internal and external documentation, projects, programs, publications, communication campaigns, official social media accounts, and any other means of communication used by the ASSOCIATION OF ONLINE CONTENT AND MODELS CREATORS (ACCMO), including, but not limited to, the name of the Association, logo, visual elements, trademarks, slogans, texts, articles, guides, regulations, document templates, forms, photographs, videos, graphic materials, illustrations, presentations, databases, website structure and design, digital platform interfaces, audio-visual content, electronic publications, newsletters, studies, research, creative concepts, educational materials, and any other works or materials created or used by the Association, represents the exclusive property of the ASSOCIATION OF ONLINE CONTENT AND MODELS CREATORS (ACCMO) and/or the rights holders who have authorized its use and is protected by Romanian and international copyright, related rights, intellectual property, trademarks, industrial designs, unfair competition, and any other applicable legal provisions.
No element belonging to the Association may be copied, downloaded, reproduced, republished, distributed, transmitted, adapted, translated, modified, processed, published, licensed, commercialized, exploited, made available to the public or used, in whole or in part, in any form and by any means, without prior, express written consent of the Association or the respective rights holder, except for cases expressly permitted by law.
Unauthorized use is strictly prohibited:
* the name of the ASSOCIATION OF CONTENT AND ONLINE MODELS CREATORS, acronym ACCMO, logo, symbols, elements of visual identity, slogans and trademarks used by the Association;
* content published on the website [www.acmo.ro](http://www.acmo.ro), on digital platforms or on the official social media accounts of the Association;
* regulations, guidelines, procedures, document templates, contracts, internal policies and any other documents prepared by the Association;
* photographs, videos, audio recordings, live broadcasts, presentations, courses, workshops, conferences and educational materials created or made available by the Association;
* databases, member lists, supporters, collaborators, partners or participants in the Association's activities;
* Any other materials or creations protected by intellectual property rights belonging to the Association.
The use of the name, abbreviation, visual identity or membership status, supporter, collaborator or partner of the Association for advertising, commercial, political, electoral, fraudulent or any other purpose that may create confusion with the official position of the Association is prohibited without prior, express and written consent from it.
The association reserves the right to request the immediate cessation of any unauthorized use of protected elements, the withdrawal of materials published in violation of its rights, as well as full compensation for material and moral damages suffered, through all means provided by law.
7. MODIFYING THE TERMS AND CONDITIONS
ASOCIAȚIA CREATORILOR DE CONȚINUT ȘI MODELELOR ONLINE (ACCMO) reserves the exclusive right to modify, update, complete, revise or delete, at any time, in whole or in part, the present Terms and Conditions, as well as any policies, internal regulations, procedures, guidelines, membership or supporter terms, benefits, facilities, projects, programs, events, digital platforms or any other documents and information published on the official website [www.acmo.ro](http://www.acmo.ro) or communicated through the Association's official channels, to the extent that such modifications are necessary for the proper functioning of the Association and in compliance with applicable legal provisions.
Changes may include, but are not limited to, those resulting from:
* modifications to applicable legislation
* modifications to the Statute, Articles of Association, internal regulations or decisions of the management bodies of the Association;
* development, reorganization or expansion of activities, projects, programs and services offered by the Association
* implementing new platforms, IT systems or digital solutions
* changes to the conditions for membership, supporter, collaborator or partner
* updates on contributions, fees, membership fees, benefits or facilities provided by the Association;
* implementing measures related to information security, data protection or internal organization;
* any objective reasons that require updating this document
The updated version of the Terms and Conditions will be published on the official website [www.acmo.ro](http://www.acmo.ro) and will take effect from the date of publication or from the date explicitly mentioned in the heading of the updated version.
Members, supporters, collaborators, partners, users and visitors are required to periodically review these Terms and Conditions, as well as other policies and documents published by the Association, in order to be informed about any changes that have occurred.
Continued use of the website, digital platforms, participation in activities, projects, programs or events organized by the Association, maintaining membership or supporter status, or continuing legal relations with the Association after the new Terms and Conditions have come into effect constitutes express acceptance of the new version of these Terms and Conditions, to the extent that law requires a different form of acceptance.
If a person does not agree with the changes made to these Terms and Conditions, they may cease using the website and platforms managed by the Association or request termination of their association or contractual relationship, as appropriate, in accordance with applicable law, Statute, and internal regulations, without affecting any rights and obligations that have already arisen or financial, contractual, or legal obligations assumed prior to the termination of the parties' relationship.
Applicable Law and Dispute Resolution
These Terms and Conditions, as well as all legal agreements arising between the ONLINE CONTENT AND MODELS CREATORS ASSOCIATION (ACCMO) and its members, supporters, collaborators, partners, users, visitors to the [www.acmo.ro](http://www.acmo.ro) website or any other person interacting with the Association, are governed and interpreted in accordance with Romanian law.
The legal relationships between the parties will be interpreted and executed in accordance with applicable laws, including, where applicable, the Civil Code, Government Order No. 26/2000 on associations and foundations, data protection legislation, e-commerce legislation, intellectual property law, accounting, tax law, and any other relevant regulations, depending on the nature of the legal relationship between the parties.
The members, supporters, collaborators, partners, users and Association undertake to use all reasonable efforts to resolve any misunderstandings, complaints, claims, disputes or litigation arising from the interpretation, performance, modification, suspension or termination of the legal relationship between the parties, by amicable means.
In this regard, the interested party will submit a reasoned complaint or claim to the Association in advance, through the official communication channels provided by the Association, thereby giving it the opportunity to analyze the situation and formulate a response or propose an amicable solution within a reasonable period.
If amicable resolution is not possible or the parties do not reach an agreement within a reasonable period from the date of notification, any dispute will be resolved by the competent courts in Romania, in accordance with the rules of jurisdiction provided for in the applicable civil procedural law.
The association cannot be held liable for the decisions, actions, or inactions of its members, supporters, collaborators, partners, or users who are exclusively based on information, materials, recommendations, or resources provided by it, to the extent that the association has fulfilled its obligations in good faith and in accordance with legal, statutory, and present Terms and Conditions.
Any disputes regarding membership or affiliation, fees, contributions, donations, sponsorships, participation in projects, programs, events or other activities organized by the Association, as well as any other rights and obligations arising from the relationship between the parties, will be resolved in accordance with the provisions of these Terms and Conditions, the Association's Statute, internal regulations and applicable laws.
Before submitting to the courts, the parties may agree to resolve the dispute through alternative dispute resolution procedures, including mediation, in accordance with Law No. 192/2006 on Mediation and the Organization of the Mediator Profession, without this procedure being mandatory.
